Before uploading a photo (“Photo”) to this site, carefully read the following Terms and Conditions of use.

Uploading any Photo to this site constitutes your acceptance (whether as the participant or as the parent/legal guardian of the participant if the participant is between 13 and 17 years of age) of the Terms and Conditions of use outlined herein. Please note: individuals under the age of 13 are not eligible to participate and should not upload a photo.

By uploading a Photo to the site, each participant (and his/her parent/legal guardian if he/she is between 13 and 17 years old) hereby:

• gives The George Brown College of Applied Arts and Technology ("Sponsor") full worldwide rights in perpetuity to use the particpant’s name and grants to Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use the Photo, in whole or in part, as is or as may be edited, in any marketing and/or communications initiatives, or to refrain from doing so;
  
  
• waives any moral rights the participant may have in the Photo in favour of Sponsor, and represents that the Photo is original and that no rights of any third party have been knowingly infringed;
  
  
• represents that the participant is the only individual included in the Photo submitted and that the participant is the photographer or that the photographer has given permission to submit the Photo for these purposes (and that if the photographer is not the participant, that the photographer has waived any moral rights in the Photo in favour of Sponsor);
  
  
• agrees to release and hold harmless the Sponsor and its advertising and promotion agencies, and each of their respective agents, employees, directors, successors, and assigns against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action.
  

I HEREBY ACKNOWLEDGE THAT MY PHOTO (OR MY CHILD’S PHOTO, IF APPLICABLE) MAY BE POSTED ON SPONSOR’S WEBSITE, IN SPONSOR’S DISCRETION, FOR VIEWING BY VISITORS TO THE SITE. I ACKNOWLEDGE AND AGREE THAT SUBMITTING THE PHOTO ONLINE BRINGS THE PHOTO WITHIN THE PUBLIC DOMAIN AND SPONSOR WILL NOT BE HELD LIABLE FOR ANY COPYING, RE-POSTING OR UNLAWFUL USE OF THE SUBMITTED PHOTO THAT MAY RESULT.

I acknowledge that I shall not be entitled to any consideration, compensation, damages, or other benefits, arising from or relating to Sponsor's use of the Photo (or any portion thereof) as described above. I confirm that the Photo conforms to the Guidelines and Content Restrictions below (“Guidelines and Restrictions”) and agree that Sponsor, in its sole and absolute discretion, may remove the Photo if it believes, in its sole and absolute discretion, that the Photo fails to conform to the Guidelines and Restrictions.

Guidelines:

• The Photo must be in one of the following formats: .JPG, GIF, or PNG.
• The Photo must not exceed 10 MB in size.

Content Restrictions:

• The Photo must not contain material that violates or infringes another’s rights, including but not limited to, rights of privacy, rights of publicity, trade-mark rights, copyrights, rights of attribution or integrity, or any other intellectual property rights;
  
  
• The Photo must not contain images, artwork, or other works protected by copyright, unless the participant has created and owns all the copyrights in such works (or has obtained all necessary rights in and to such materials);
  
  
• The Photo must not contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libelous, or that depicts unsafe or illegal conduct (all as determined by the Sponsor in its sole discretion);
  
  
• The Photo must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and
  
  
• The Photo must not violate or contain material that violates federal, provincial or municipal laws or regulations.

Sponsor retains the right to reject any photo in its sole and absolute discretion.
